GEMO LIMITED WARRANTY POLICY

Thank you for your interest in the products and services provided by Gemo Limited (“Gemo”, “our”, “we” or “us”). The limited warranty applies to physical goods, and only physical goods, purchased from Gemo or our authorised retailers and e-commerce platforms for your own domestic use and not for resale (“Products”).

1. Limited Warranty Coverage and Limitations

      1. Subject to any other conditions and restrictions outlined in this Warranty Policy, Gemo warrants that each Product that you purchase will be free from defects in both materials and workmanship under normal use in accordance with Gemo’s published product materials during the Warranty Period (as defined hereunder). Such published product materials include, without limitation to, user manuals, safety guidelines, specifications and service communications, as well as other use instructions as provided to you and updated from time to time.
      2. This Warranty Policy, as a commercial warranty, provides you with contractual rights. Nothing in this Warranty Policy affects or limits your statutory warranty rights according to the applicable laws of your jurisdiction of residence, including rights of consumers under laws and regulations governing the sale of consumer products that cannot be waived or limited by agreement.
      3. You, in your capacity as a consumer, acknowledge being informed, even before placing an order, and declare that you are fully aware of the legal warranties under the applicable law, which you benefit from by right and without any additional payment, on the Products.

  2. Warranty Period

      1. The Warranty Period commences on the date of delivery of the Product when first purchased on Gemo’s Website or through our authorised retailers and e-commerce platforms, each for domestic and non-resale use and continues for a period of two years.

3. What Will Gemo Do to Resolve the Problem?

          1. If a Product does not function as warranted during the Warranty Period and you have submitted a valid claim as set out under Section 4 below, Gemo will at its option:
            1. repair the defective Product at no cost, utilising new or functionality equivalent to new replacement parts; or
            2. replace the defective Product with a new Product.
          2. Each repaired or replaced Product supplied to you will be warranted only for the unexpired portion of the original Warranty Period.
          3. If a repair or replacement is not possible, any claim for loss or damages claimed to arise from the Product defect will be subject to the terms set out in the Section ‎7 of this Warranty Policy.
          4. When warranty service involves the replacement of a Product or its parts, the original Product or parts will become Gemo’s property and the replaced Product or parts will become your property.

      4. How to Obtain Warranty Service?

        1. You may request warranty service by contacting our customer service team at customercare@gemoglobal.com. Please ensure that your request contains the below information:
          1. a valid proof of purchase – acceptable forms of proof include a receipt indicating the purchase date of the Product, or a comparable sales document;
          2. the relevant order number, Product model and Product serial number;
          3. a description of the defect;
          4. your contact details; and
          5. other information which may help us to process your request (optional).
        2. If your claim is approved, we will send you an email confirmation.
        3. We will send a pre-paid shipping label to your address for you to return the Product. Please include all items that were in the original packaging.
        4. Gemo reserves the right to void this Warranty Policy, to the extent permitted by law, if:
          1. you are in breach of this Warranty Policy or the terms of sale of the Product;
          2. the Product has not been returned to Gemo following a refund;
          3. the Product is used outside the market where it is purchased (for the purpose of this Warranty Policy, the European Union shall be viewed as a single market); or
          4. if Gemo identifies that the Product is connected with any suspected fraud or if the Product is counterfeit, stolen or lost during shipment.
  1.  5. What Is Not Covered?

      1. This Warranty Policy does not extend to any second or subsequent owner of the Product.
      2. Products obtained from unauthorised sellers, including unauthorised Internet sites, are not eligible for coverage under this Warranty Policy.
      3. This Warranty Policy does not cover damages resulting from:
        1. normal wear and tear caused by your use of the Product, including but not limited to cosmetic damage such as scratches, dents or broken plastic;
        2. accidents, misuse, abuse, exposure to dirt or water, tampering, unreasonable use, or neglect of reasonable and necessary maintenance; or
        3. service operations carried out or attempted by unauthorised service agencies.
      4. Only Products purchased through authorised channels in their original condition are covered by this Warranty Policy. Please note that complimentary gifts or items provided with the Product, or items won through Gemo giveaways are not covered under this warranty.

      1. We will need to use your personal information to provide the warranty service requested by you, including but not limited to your request details and your contact information such as your name, phone number, address, and e-mail address. Gemo will process your personal information in accordance with our https://gemoglobal.com/policies/privacy-policy and the applicable laws.

      1. Except to the extent prohibited by applicable law, Gemo shall not be liable for any indirect damages, or any loss of profits, revenue, or data, resulting from any breach of express or implied warranty or condition, or under any other legal theory, even if Gemo has been advised of the possibility of such damages. 
      2. The above liability restrictions shall also apply in favour of our representatives, employees and agents.
      3. The above liability restrictions do not apply in the event of intent, fraud or gross negligence, or where there are conflicting provisions under applicable statutory law which shall prevail.
